Former commander of the Lviv Territorial Defense Brigade, Arthur Horbenko, has been released from custody.

The appellate court altered the preventive measure to house arrest.

On Thursday, February 27, the Kyiv Appeal Court altered the preventive measure for the former commander of the Lviv 125 Brigade of the Territorial Defense, Lieutenant General Artur Horbenko.

According to MP Rostyslav Tistyk, who was present in the courtroom, the preventive measure has been changed from detention to round-the-clock house arrest.

«Lieutenant General Artur Horbenko has had his preventive measure changed to house arrest. Artur Ivanovych thanks everyone for their support and greetings», – wrote Rostyslav Tistyk on Facebook.

The decision to change the preventive measure was made on Artur Horbenko's birthday; he turned 61 today.

On January 20, DBR employees, together with the SBU, detained former commander of the Lviv 125 Brigade of the Territorial Defense Artur Horbenko, former commander of the operational-tactical group of troops "Kharkiv" Yurii Halushkin, and commander of the 415 battalion of the 23rd Brigade Ilya Lapin. All three were accused of negligent performance of military duties, resulting in serious consequences (part 4 of article 425 of the Criminal Code of Ukraine). The former commander of the 415 battalion was also charged with voluntary abandonment of the battlefield (article 429 of the Criminal Code of Ukraine).

According to the investigation, due to the negligence of the aforementioned military commanders, the enemy was able to seize part of the territory of Kharkiv region in May 2024. The sanctions of the articles they are charged with provide for a penalty of up to 10 years in prison.

On January 22, the Pechersk District Court of Kyiv imposed a preventive measure on Artur Horbenko – detention for a period of two months with the possibility of posting bail in the amount of 25 million UAH.
