The Railway District Court of Lviv has issued a verdict for driver Roman Yaschyk, who fatally struck a pedestrian with his ZAZ Lanos in 2018. The court has sentenced him to 3 years of probation.
According to the case materials, the accident occurred on December 21, 2018, on Hordotska Street in Lviv. Roman Yaschyk, driving the ZAZ Lanos, was heading towards Vyhovskoho Street. Near house No. 168, he struck a pedestrian at an unregulated crosswalk, who later died in the hospital from the injuries sustained.
In court, Roman Yaschyk admitted his guilt and explained that he tried to avoid the accident with the pedestrian but was unable to do so. Additionally, the pedestrian was talking on his mobile phone and was intoxicated while crossing the road. Yaschyk also compensated the deceased's family with 250,000 UAH and signed an agreement for an additional 200,000 UAH in compensation.
Taking into account the circumstances of the case, Judge Bohdana Heds of the Railway District Court found Roman Yaschyk guilty under part 2 of Article 286 of the Criminal Code of Ukraine and sentenced him to 5 years in prison. However, the court released him from serving the sentence, substituting imprisonment with 3 years of probation. This verdict can be appealed.
