The Supreme Court has legalized a coffee kiosk that was expanded in the center of Lviv.

The city council insists that the kiosk on public land was constructed without the necessary permits.

The Supreme Court has upheld the decision of the Economic Court and denied the Lviv City Council's lawsuit against PP "Loreleya," which demanded the dismantling of the expanded kiosk located at 3 Pidkova Square and the release of the illegally occupied municipal land.

This concerns the kiosk at 3 Pidkova Square, where the "Aroma Coffee" café is currently located. According to the case materials, the land plot of 0.0066 hectares at 3 Pidkova Square is in municipal ownership. On this plot is a kiosk with an area of 48.3 m2, which was privatized by PP "Loreleya" back in 2006.

The company has leased this plot from the city council since 1997; however, it currently does not have valid rights to use or lease the land, as in 2021 the city council denied PP "Loreleya" an extension of the lease for the land plots at Pidkova Square. Nevertheless, the company continued its business activities there and expanded the premises from 48.3 m2 to 58.9 m2. Additionally, the city council did not issue the necessary urban planning conditions and restrictions for the kiosk's expansion, prompting the city council to take legal action to reclaim the municipal land and dismantle the unlawfully reconstructed building.

However, the court expert examination confirmed that the kiosk's area is 48.3 m2, and the court found no evidence that PP "Loreleya" had expanded this space. Furthermore, the company claims that despite the Lviv City Council not renewing the lease agreement since 2021, it continues to pay the rent.

In June 2024, the Economic Court denied the Lviv City Council's lawsuit and annulled the ruling on securing the claim. In November, the decision was upheld by the Western Appeal Economic Court. On February 11, the Supreme Court confirmed the decisions of the previous instances. This ruling is final and cannot be appealed.

PP "Loreleya" was registered in 1995 and is owned by Lviv resident Tetiana Nikitchin, the former owner of the "Tsisar's Coffee" café on Shevchenko Avenue.
